Terms of Service & End User License Agreement (EULA)

1. Acceptance of Terms

By downloading, installing, accessing, or using the Subly mobile application (the "App"), you agree to be bound by these Terms of Service and End User License Agreement ("Terms" or "EULA"). If you do not agree to these Terms, please do not use or install the App.

These Terms constitute a legally binding agreement between you ("End-User") and Bansaree Bhalsod ("Licensor" or "Developer"), incorporating Apple's Standard Licensed Application End User License Agreement (Apple Standard EULA).

2. End User License Agreement (EULA) & Scope of License

Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App solely for your personal, non-commercial purposes on Apple-branded products running iOS/iPadOS 17 or later that you own or control, as permitted by the Apple App Store Terms of Service.

You may not distribute, lease, sell, transfer, decompile, reverse engineer, or attempt to derive the source code of the App or any updates thereof.

3. Description of Service

Subly is a privacy-first subscription management application that allows you to:

  • Manually track and organize your recurring subscriptions and bills.
  • View upcoming renewal dates via an interactive calendar.
  • Analyze spending history, price changes, and payment timelines.
  • Receive local push notifications for upcoming renewals.
  • Sync your subscription data across Apple devices via iCloud CloudKit.
  • Export and import subscription data via CSV files.
  • Use Home Screen and Lock Screen widgets.

Subly is a manual-entry tracking tool. It does not connect to your bank accounts, credit cards, or financial institutions.

4. In-App Purchases, Subscriptions & Billing Terms

Subly offers optional Auto-Renewable In-App Subscriptions and Lifetime Purchase ("Subly Pro"):

  • Monthly Premium: $0.99 per month (flexible, auto-renews monthly until canceled).
  • Yearly Premium: $12.99 per year (auto-renews annually until canceled, saving ~9% compared to monthly).
  • Lifetime Access (VIP): $24.99 one-time payment (unlimited access to all current and future Pro features with no recurring charges).
  • Free Trial: New subscribers to the Yearly plan receive a 3-day free trial. If you do not cancel at least 24 hours before the end of the 3-day trial period, your subscription will automatically convert to the annual paid subscription.

Payment & Auto-Renewal: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

Trial Forfeiture: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

Subscription Management & Cancellation: You can manage or cancel your subscriptions at any time by going to your Apple ID Account Settings after purchase (Settings → Apple ID → Subscriptions).

Refunds: All financial transactions and refunds are managed directly by Apple. If you wish to request a refund, visit reportaproblem.apple.com.

5. Maintenance, Support & Product Claims

Bansaree Bhalsod is solely responsible for providing any maintenance and support services for the App as specified in these Terms or required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Bansaree Bhalsod, not Apple, is responsible for addressing any claims by the End-User or any third party relating to the App or the End-User's possession and/or use of the App, including product liability claims, legal or regulatory non-compliance claims, and consumer protection claims.

You agree that Licensor may collect and use technical data and related information as described in our Privacy Policy. Your subscription data is stored locally on your device and optionally synced using your private iCloud account. Licensor does not collect or sell your personal financial data.

7. Intellectual Property Rights

All intellectual property rights in the App, including design, code, graphics, logos, and UI components, are owned by Bansaree Bhalsod. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Bansaree Bhalsod (and not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

8. Legal Compliance & Warranty Disclaimer

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

9. Apple Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bansaree Bhalsod shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the App.
